Course Description & Objectives: 

The aim of this subject is the general application of principles of law of contract to cover building and civil engineering contracts.  Formation of building contracts; essential offer and acceptance implied terms; mistakes; misrepresentation.  Distinction between tendering and procedures and contractual arrangements; selection appointment, tenders and estimates, tender documents; acceptance of tender; contractual relations between persons connected with contracts; lump sum, schedule, cost reimbursement, sub-contractors, suppliers and statutory authorities.  The relationship between building and civil engineering contracts:  The principle statutes affecting them and common law.  Factories Act, Building Bye-Laws, Public Health Act, Contact Act, national working rules.  Legal rights and obligations of the following parties to a building and engineering contract; consideration of principle contractors Obligation to carry out and complete the work, to give possession of site etc. sureties; supplying instructions as to carrying out the work.  Duties and liabilities of architect, quantity surveyor and engineer in building and engineering contracts.  Remuneration of architect, quantity surveyor, engineers for service contracts.
