Course Description & Objectives: 

Nature and sources of law, Classification of law, Sources: principal and subsidiary.  Common law and equity, Statute law.  Court systems in East African legal terminology; Law of Contract; The essentials of a valid contract; offer and acceptance: intention to create legal relations.  Terms of contract, from and consideration.  Capacity of the parties, reality of consent; vitiating factors: mistake, misrepresentation, duress and undue influence, contracts uerrimea fidei and illegality.  Discharge of contracts by performance agreement, frustration (subsequent impossibility), breach, operation of law. Remedies:  damages, injections, and specific performance.  Limitation of actions, privacy of contract and assignment of choose in action.  Hire-purchase contracts, bachements; Law of Torts, Nature of tortious liability.  General defences to an action in tort:  Volenti non fit injuries.  Mistake, inevitable accident, act of God, self-defense, necessity of action, act of stages; parties to an action in tort, vicarious liability, negligence, strict liability, occupiers’ liability.  Trespass to personal property (goods) and Land.  Nuisance; defamation.
